These Terms of Use ("Terms") govern your access to and use of aylio.com (the "Site") operated by Aylio Wellness ("Aylio," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms.
1. Eligibility and Acceptance
You represent that you are at least the age of majority in your jurisdiction and legally able to agree to these Terms. If you do not agree, do not use the Site.
2. Informational Content Only
Site content is provided for general wellness and product information only. It is not medical advice, diagnosis, or treatment and does not create a healthcare provider-patient relationship.
3. Purchases Through Third Parties
Purchases are completed through third-party marketplaces, including Amazon. Pricing, availability, checkout, shipping, refunds, and return processing are controlled by those third parties at checkout.

The Site may link to third-party services, including Amazon and YouTube. We do not control and are not responsible for third-party content, terms, or privacy practices.
8. Disclaimer of Warranties
To the fullest extent permitted by law, the Site and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, or uninterrupted availability.
9. Limitation of Liability
To the fullest extent permitted by law, Aylio and its officers, directors, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, loss of goodwill, business interruption, or procurement of substitute services.
To the fullest extent permitted by law, Aylio's aggregate liability for any claim related to the Site will not exceed the greater of (a) USD $100 or (b) amounts paid directly to Aylio through the Site in the twelve (12) months before the claim arose.
Nothing in these Terms limits liability that cannot be excluded by law, including liability for gross negligence, willful misconduct, or fraud where applicable.
10. Assumption of Risk
You voluntarily use the Site and any product information at your own discretion and risk. You are solely responsible for evaluating whether a product is appropriate for your individual needs.
11. Indemnification
You agree to defend, indemnify, and hold harmless Aylio and its affiliates, officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Site, your violation of these Terms, or your violation of law or third-party rights.
12. Dispute Resolution and Arbitration
Informal dispute process
Before filing a claim, you agree to first contact us at max@aylio.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration
Except for claims that qualify for small claims court, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration under the Federal Arbitration Act. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect.
Class action and jury waiver
You and Aylio agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, representative, or private attorney general action. You and Aylio waive any right to a jury trial to the fullest extent permitted by law.
Arbitration opt-out
You may opt out of arbitration and class-action waiver within 30 days of first accepting these Terms by emailing max@aylio.com with your full name, mailing address, and a clear statement that you wish to opt out.
13. Governing Law and Venue
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. For disputes not subject to arbitration, the exclusive venue is state or federal courts located in Kings County, New York, and each party consents to personal jurisdiction there.
14. Time Limit to Bring Claims
To the extent permitted by law, any claim arising out of or related to the Site or these Terms must be filed within one (1) year after the claim arose, or it is permanently barred.
15. Termination
We may suspend or terminate access to the Site at any time, with or without notice, for security, legal, operational, or misuse reasons. Sections intended to survive termination remain in effect.
16. DMCA and Copyright Notices
If you believe material on the Site infringes your copyright, send a notice to max@aylio.com with: (a) your contact info, (b) identification of the copyrighted work, (c) identification of the allegedly infringing material and its location, (d) a good-faith statement, and (e) a statement under penalty of perjury that you are authorized to act.
17. Changes to These Terms
We may update these Terms by posting a revised version on this page with a new effective date. Continued use after updates means you accept the revised Terms.
18. Severability, Assignment, and Entire Agreement
If any provision is held unenforceable, the remaining provisions will remain in full force. You may not assign these Terms without our written consent. These Terms, along with referenced policies, are the entire agreement regarding Site use.
